Within the meaning of the article 5 of the D. Lgs. 22 May 1999 n. 185, the Client (if classified as “consumer” pursuant to article 1. lett. b) of D. Lgs. 22 May 1999, 185). Shall be entitled to terminate the contract and return the ordered products, without penalty and without giving any reason, within the 10 (ten) day period of working days from the receipt of the products.
The right of withdrawal provided for under article (art. 5 of D. Lgs. 22 May 1999 n. 185) must be exercised by the client, under penalty of decadence by registered letter to NUOVA COMASS SRL, Via Pradoni 1/3, 26010 Sergnano (CR), within 10 (ten) working days from the receipts of products. All the returns (that should be uncorrupted and accompanied by original packaging) should be allowed by NUOVA COMASS SRL, that will release an authorization number no re-entry (RMA). Once received RMA number, the client can send at this own expense the product to the following address: NUOVA COMASS SRL, Via Pradoni 1/3, 26010 SERGNANO (CR) it will not be accepted pack COD.
Once received the products (and verified their integrity) NUOVA COMASS SRL, as promptly as possible, and otherwise within 30 working days from the delivery, will credit to the client the returned products’ cost price (as shown in the invoice), withholding, where necessary, the amount of the shipping costs that will remain in charge of the Client.
The right of withdrawal provided for under article (Art 5 of D. Lgs. 22 may 1999 n.185) may not be exercised by the Client in the event that the purchased products have been used (or damaged) by the Client itself.
The right of withdrawal will not be applied to the Client who buys for the work purposes (for example: objective use, resale) and that therefore communicates to NUOVA COMASS SRL his own P.I.
Pursuant to and in accordance with articles 1341 and 1342 of the Civil Code, the Client states to have read, understood and accepted the following clauses of NUOVA COMASS SRL general sales conditions.
